Privacy Policy — International

This Privacy Policy describes how FactuTPV, LLCprocesses the personal data of customers located outside the European Union who use the FactuTPV service. Customers in the European Union are covered by the Spanish entity's Privacy Policy.

1. Data controller

2. Scope

This policy applies to customers outside the EU billed by FactuTPV, LLC. Where the Customer enters data about their own customers or employees into the platform, the Customer acts as the controller of that data and FactuTPV processes it on the Customer's behalf in order to provide the service.

3. Data we process

  • Account data: name, email, business details and country.
  • Billing data: that required to process the subscription payment through the gateway (the gateway processes card data; FactuTPV does not store the full card number).
  • Usage data: technical logs, IP address and usage events, for security and service improvement.
  • Customer content: the data the Customer enters (sales, products, customers, employees), processed on the Customer's behalf.

4. Purposes

We process data in order to: provide and maintain the service; manage sign-up, billing and subscription renewal; provide support; ensure security and prevent fraud; comply with applicable legal obligations; and communicate relevant service information.

5. Providers and processors

We use providers that process data on our behalf under the corresponding contractual safeguards, including: Stripe (payment processing), our infrastructure/hosting provider and our email provider. We do not sell personal data.

6. Retention

We retain data while the account is active and for the period necessary to comply with legal obligations, resolve disputes and enforce our agreements. After cancellation, the Customer may export their data for a reasonable period, after which it may be deleted.

7. Security

We apply reasonable technical and organisational measures (encryption in transit, access control and audit logs) to protect the data. No system is completely secure, but we work to maintain an appropriate level of protection.

8. International transfers

FactuTPV, LLC is a United States entity and the infrastructure may be located in different jurisdictions. By using the service, the Customer understands that their data may be processed outside their country of residence, subject to the applicable contractual safeguards with our providers.

9. Your rights

Subject to the regulations applicable in your country, you may request access to, rectification, erasure or portability of your data, and object to certain processing. To exercise these rights, write to privacy@factutpv.com.

10. Cookies

We use cookies and similar technologies that are necessary for the service to function and, where applicable, for analytics and improvement. You can manage cookies from your browser's settings.

11. Minors

The service is aimed at businesses and professionals; it is not intended for minors and we do not knowingly collect data from minors.

12. Changes

We may update this policy. We will publish the version in force with its update date and, where appropriate, notify material changes.

13. Language

This policy is published in English, which is its authentic version. Translations into other languages are provided for information only; in the event of any discrepancy, the English version prevails. The language of the agreement itself is governed by section 15 of the International Terms.
